*To remain RESPA compliant you must:
Use TMS through your Brokerage.
The only way you can pass this cost along is if it’s a cost that is charged by your brokerage (RE/MAX Gold TMS is a part of our brokerage!)
The TMS charge must be disclosed in writing
The cost must be passed through at the exact cost (no mark-up allowed)
FOR SELLERS, cost must be disclosed in the RLA (listing agreement)
Use “In addition, Seller agrees to pay Broker…” in item 3C
FOR BUYERS, cost must be written in the BRNE
Use “Buyer Broker Non Exclusive” in item 3A(2)
